1.  Introduction

• This website (the "Website"), is owned operated and maintained by Simon Fisher Letting and Management (“Simon Fisher”). Simon Fisher Letting and Management provide residential letting and management services to Landlords with properties around Oxfordshire.
• By accessing, registering and using the Website, and participating in activities within the site, you agree to be bound by these terms and conditions.

2.  Warranties

       

        You warrant that:-

• All details that you provide to us are true and correct and you will keep the information updated.
• Your use of the Website will not violate these terms and conditions nor breach any applicable laws.

3.  Content

       

        In relation to content posted by you on the Website:

• You are responsible for all information which you post, upload or display to the Website.
• You will not post any material which is false, defamatory, inaccurate, abusive, vulgar, harassing, obscene, threatening, invasive of a person’s privacy, pornographic, or otherwise in violation of any UK Laws relating to on-line conduct and with any applicable international laws (“Applicable Laws”).
• You grant other users of the Website the right to access the content.
• You grant us a non exclusive, royalty free, sub-licensable, perpetual worldwide license to use, modify, publish display and distribute such content on and through the Website and in any other form or medium.
• You will not upload, post or otherwise display any content which may contain software viruses, or any that contains chain letters, bulk mail, junk mail, spam or similar.

4.  Access restriction, Suspension, Termination and Alteration

• Simon Fisher Letting and Management may at any time without notice and for any reason deny you access to the Website.
• You agree that we may delete, edit, lock, move or remove any content without notice and for any reason and/or to record the IP address from which any content is posted, uploaded or displayed without notice and for any reason, (including, without limitation) content which is in breach of these terms.
• If you are in breach of any of these terms, Simon Fisher Letting and Management may reveal your identity or any other related information collected on this service and to such extent such action constitutes processing for the purpose of the Data Protection Act you hereby consent to such processing. Our Privacy Policy can be found on this website.

5.  Indemnity and Exclusion of liability

• Use of the Website is at your own risk. Both are provided on an “as is” basis.
• You are solely responsible for how you interact with other users of the Website.
• Simon Fisher Letting and Management disclaims all liability whatsoever whether arising in contract, tort (including negligence) as a result of or in connection with the Website for any economic loss, loss of goodwill or reputation, or special or indirect or consequential loss or otherwise and all implied warranties terms and conditions relating to the Website are hereby excluded. In particular Simon Fisher Letting and Management accepts no responsibility for any loss or damage sustained by you as a result, directly or indirectly arising out of:
  • The conduct of any user of the Website.
  • Any technical or other failure of the Website.
  • Your attendance at events and meetings with other users of the Website. Simon Fisher Letting and Management does not provide any warranty as to the fitness or otherwise of the venue nor the owner and/or operator of the venue at which meetings take place.
  • Any dealings that you have with any users of the Website.
  • Any subsequent arrangements, contracts, agreements or business relationships that you enter into with any person as a result of or facilitated by your use of the Website.
• Nothing in these terms shall limit liability for death or personal injury caused by negligence.
• You agree to indemnify us in full and on demand against any loss, damage, costs or expenses which we suffer or incur directly or indirectly as a result of your use of the Website.

6.  General

• We may update these terms from time to time at our discretion. Amended terms shall become effective as soon as they are placed upon the Website and your continued use of the Website constitutes acceptance by you of the updated terms.
• All amendments will be notified to all visitors via the Website.

7.  Incentive Scheme

• Rewards are only assigned to the referring party upon the letting out of a ‘new Landlords’ property.
• The products Safe Start and Safe Start + are specifically excluded from the Incentive Scheme.
• For the purpose of the Incentive Scheme a ‘new Landlord’ introduction is defined as follows;

                (a)          A ‘new Landlord’ must not have previously engaged the services of Simon Fisher Letting and Management in the last 10 years.

                (b)          A ‘new Landlord’ may already be captured in our database system, but will not be engaged as identified in (a).

• Rewards are only assigned for ‘new Landlord’ signings and all other introductions are specifically excluded.
• Simon Fisher Letting and Management reserve the right to change, cancel and withdraw the Incentive Scheme at any point in time.  Notice of such changes will be posted on the website for a period no less than 7 days.

                (a)          In the event of changes to the scheme, all previously confirmed ‘new Landlord' introductions will be honoured, in full, as required.

                (b)          Should a ‘new Landlord’ introduction be made following a change to the scheme recognition and acceptance of any such introduction is at    

                               the discretion of Simon Fisher Letting and Management and any decision will be final.

• Unless stated otherwise, all other promotional benefits are specifically excluded from the Incentive Scheme.
